HRCM welcomes Civil Court verdict

News | 06 March 2008

Ms. Aashiyath Najeeb, who was an employee at Rathafandhoo Health Centre lodged a complaint to the Human Rights Commission (HRCM) to protect her right to employment, claiming that she was unlawfully dismissed from her post as a family health worker.

After investigating into the matter and collecting information from various relevant sources of the government the HRCM concluded that there was no substantial evidence to support her dismissal as lawful and advised her that she had solid grounds to contest the decision by her employer in a court of law.

Accordingly, Ms. Najeeb took up her case at the Civil Court where the Court passed a judgement in her favour establishing the dismissal as unlawful and for the Government to reinstate her to her original post or one that is equivalent to her former position as family health worker.

Furthermore, the court also instructed the Ministry of Health to award the total amount due to her in salary payments from the date of dismissal to the date of reinstatement within 15 days of this court decision.
